A foreign national is ineligible for LMIA, instead, Canadian employers are entitled to LMIA. Work Permit Application Process Once positive or neutral LMIA is obtained, the Canadian employer must give the Foreign Worker wishing to apply for work permit, a copy of the approved LMIA with a job offer letter.

The selected foreign worker must be informed by the employer that they will be receiving a reference letter once their application for work permit has been approved. Canadian employers are required to receive a document from Employment and Social Development Canada (ESDC)/Service Canada that indicates that they are allowed to employ the temporary worker. The actual work permit is issued by the ESDC, which, after considering a number of protections in the labor market, authorises a Canadian employer to employ a foreign worker. A Labour Market Impact Assessment (LMIA) is a document an employer in Canada may be required to obtain prior to hiring a foreign worker. In most cases, employers are required to obtain governmental approval prior to hiring a foreign worker, which is now called a labour market impact assessment (LMIA), previously known as a labour market opinion (LMO). Global Talent Stream applications are processed through the Temporary Foreign Worker Programme (TFWP), a series of employment authorization streams which brings newcomers into Canada under temporary employment authorizations to fill Canadas particular labor needs.
